Welcome to Komponent Works, a provider of various services, including Gatherlytics, Komponents, and Managed Gather Office. By using our services, you agree to the following terms and conditions: Acceptable Use: You agree to use our services only for lawful purposes and not to use them in any way that violates any applicable laws, regulations, or third-party rights. Account Creation: In order to use our services, you must create an account on Komponent Works. You agree to provide accurate and complete information when creating your account and keep your account information current. Payment and Fees: Gatherlytics offers two pricing plans. The digital office plan is billed monthly, while the event plan is a one-time fee. If you plan on using Gatherlytics for an event space, you must inform us so we can manually add the event fee to your invoice. If you fail to inform us, but the data makes it apparent that your space was used to host an event, we reserve the right to charge you the event fee. Data Ownership: You retain ownership of all data you upload to our services, but you grant us a non-exclusive, worldwide, royalty-free license to use, copy, modify, and distribute that data as needed to provide our services. We also reserve the right to monitor any space you add to Gatherlytics, use Komponents with, or have us manage for you to improve our service. Data Privacy: We are committed to protecting your privacy and the privacy of your Gather.Town digital office or event metaverse. We will not share your data with third parties except as required by law or as necessary to provide our services. We may use your data to improve our services or to provide you with customized reports or recommendations. Intellectual Property: Our services, including Gatherlytics, Komponents, and Managed Gather Office, and all related content and services are the property of Komponent Works and its affiliates. You agree not to copy, modify, distribute, or otherwise use our content or services without our express written permission. Advertising and Promotional Use: Komponent Works retains the right to advertise with and use the Customer's name and logos for promotional, sales, and marketing purposes. This includes, but is not limited to, displaying the Customer's name and logo on Komponent Works' website, social media channels, and other marketing materials. By using our services, the Customer grants Komponent Works the right to use their name and logo for advertising and promotional purposes. However, Komponent Works will not disclose any confidential information about the Customer's business or their use of our services without the Customer's prior written consent. Limitation of Liability: We will not be liable for any damages arising out of your use of our services, including but not limited to lost profits, lost data, or any other incidental or consequential damages. Indemnification: You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our services, including but not limited to any claims by third parties for infringement of their intellectual property rights. Governing Law and Jurisdiction: These terms and conditions shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflicts of law provisions. Any dispute arising out of or in connection with these terms and conditions shall be exclusively resolved by the courts of Stockholm, Sweden. Termination: We may terminate your access to our services at any time for any reason. Upon termination, you will not be entitled to any refund of fees paid to us. You will retain access to the platform until the next billing date. By using our services, you acknowledge that you have read and agree to these terms and conditions. If you do not agree to these terms and conditions, do not use our services.
